TERMS & CONDITIONS

1. Introduction

   • The Prize Draw is organised and run by Elida Beauty Ltd (“Elida”), who can be contacted at Unilever House, 100 Victoria Embankment, London, EC4Y 0DY, United Kingdom.

   • By entering this Prize Draw, you agree to these Terms and Conditions (the “Terms”) and any decisions reached by Elida, which are final and binding in all matters related to this Prize Draw.

   • The Prize Draw starts at 09:00 (BST) on 16 June 2023 and ends at 23:59 (BST) on 30 September 2023 (the “Prize Draw Period”).

2. Who can enter this Prize Draw?

   • Participants must:

     • be residents of, and have a postal address in the United Kingdom; and

     • be aged 18 or over.

   • The Prize Draw is not open to directors, members, partners, employees, agents or consultants of Elida, any person who directly or indirectly controls or is controlled by Elida, or any supplier of goods or services in connection with the Prize Draw, or their spouses, life partners, business partners or immediate family members.

   • By entering the Prize Draw, you hereby warrant that all information submitted by you is true, current and complete. Elida reserves the right to verify the eligibility of all participants and disqualify a participant for submitting false information.

3. How does the Prize Draw work?

   • No purchase is necessary to enter the Prize Draw and entry is free.

   • To enter the Prize Draw, participants must scan the QR code, follow @matey_adventures on Instagram, and tag a friend or person (tagging their Instagram account) in the comments section of the Prize Draw post on @matey_adventures (an “Entry”) (being “Entries” when referred to in the plural).

   • Each participant can only enter the Prize Draw once (this means Entrants cannot submit Entries via separate Instagram accounts). For the avoidance of doubt, if a participant has entered more than once, only their first Entry will be accepted and constitute a valid Entry. If a submission fails to satisfy any or all requirements of an Entry, it will not be counted as a valid Entry and will be void. 

   • All Entries must be received by Elida during the Prize Draw Period or they will be void. Elida will not accept responsibility for:

• Prize Draw Entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any postal failure, equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or

• any change in dates, times or cancellations or other arrangements that may prevent a winner from accepting, taking or using a prize.

• Following the end of the Prize Draw Period and on a date no later than 12th October 2023, two (2) winners of the Grand Prize and five (5) runners up will be selected at random, using a random computer-generated process, from all valid Entries received.

• The winners will be notified before 12th October 2023 following the end of the Prize Draw Period, via an Instagram Direct Message to the account that entered the Prize Draw (“Notification”).

• The Grand Prize (defined below) and Runner Up Prize (defined below) must be claimed in accordance with the instructions in the Notification within five (5) days of the Notification (the “Claim Period”) by replying to or answering the Notification (as applicable). In order to receive their prize, the winners will also need to provide Elida with any further information requested by Elida, in accordance with the instructions set out in the Notification within the Claim Period. Failure to claim the Grand Prize or Runner Up Prize in accordance with the instructions in the Notification within the Claim Period will result in the forfeit of the Grand Prize or Runner Up Prize and an alternative winner will be chosen.

• The winner may be required to provide Elida with proof of identification in order to verify compliance with the eligibility requirements for the Prize Draw.

• If a winner is found to be ineligible or fails to comply with the Terms, then the winner may, in Elida’s sole discretion, be disqualified and an alternative winner will be selected.

 

4. What is the Prize?

• There will be two (2) Grand Prize winners and five (5) Runner Up Prize winners.

  • The Grand Prize winners will receive a year’s worth of swimming lessons with Better Swim School – this is one lesson a week for a maximum of 50 weeks, due to no lessons taking place from 21st December 2023 to 3rd January 2024 (inclusive), and a year’s supply of Matey Bubble Bath, up to a maximum of 12 bottles (the “Grand Prize”). For the Grand Prize: (i) the swimming lessons will be provided at selected locations only – see the list HERE  – and each winner shall be responsible for their own transportation to and from the swimming classes; (ii) winners must arrange swimming lessons with Better Swim School directly and can select the start date for the swimming lessons within 3 months of the Notification; and (iii) the lessons will expire following 12 months from the start date; and (iv) swimming lessons (including, but not limited to booking, cancellation, duration, participation, and attendance) will be subject to Better Swim School’s terms and conditions, which can be found here: https://www.better.org.uk/legal-policies. If the winner fails to book with a participating Better Swim School within 3 months of the notification, the swimming lessons element of the Grand Prize shall be forfeited.

  • The Runner Up Prize winners will receive a years’ supply of Matey Bubble Bath, up to a maximum of 12 bottles (the “Runner Up Prize”).

  • It is the responsibility of the winner to ensure that they comply with any terms and conditions that apply to the Better Swim School, including any set out on Terms and Policies | Better UK. 

  • The Matey Bubble Bath shall be shipped to each of the winners of the Grand Prize and Runner Up Prize to the address nominated by them in advance. Elida shall be responsible for the cost of such shipping.

• Both the Grand Prize and Runner Up Prize are non-transferable, non-exchangeable, and have a cash value of zero. The Grand Prize and Runner Up Prize are for personal use only and is not for resale. The Grand Prize and Runner Up Prize may be forfeited in the event that Elida determines that the Prize is being misused. Elida reserves the right to substitute a prize of an equal or greater value in its absolute discretion.​

 

5. General

• The winners may be required to participate in reasonable post-event publicity and agree to any such content being shared across Elida social media channels, including recognised partner channels. Elida will not use any of the winners’ personally identifiable information for post-event publicity purposes without first obtaining their consent to do so.

• Elida reserves the right to amend the rules of the Prize Draw, to withdraw the Prize Draw at any time if circumstances beyond its control make this unavoidable, or to cancel the Prize in the event of non-compliance with these Terms.

• Elida will use your personal details to contact you for administrative purposes relating to this Prize Draw.

• If you have elected to be added to Matey’s email database, you will also receive promotional emails with offers, news, products, and information. You can unsubscribe at any time.

• By entering the promotion, all entrants will be deemed to have consented to the transfer of their personal data to Elida Beauty Limited for the purposes of the administration of this promotion and any other purposes to which the entrant has consented.

• Elida will keep your personal information safe and will use your personal information in accordance with the privacy policy available on its website (https://www.unilevernotices.com/privacy-notices/united-kingdom-english.html).

• The winner’s surname and county will be made available. The winner will have the right to object to this information being published or to request a reduction in the amount of information being published. Elida may be required to provide this information to the relevant regulatory authorities.

• The decision of Elida regarding any aspect of the Prize Draw is final and binding and no correspondence will be entered into about it.

• Any cancellation or changes will be posted on the Prize Draw page HERE 

• With the exception of liability which cannot be excluded by law, Elida is not liable for, and you release Elida from, liabilities relating to any direct or indirect loss or damage which is suffered as a result of entering the Prize Draw, failing to win, winning, accepting or using a Prize. For clarity, as between Elida and Better Swim, Better Swim shall be entirely responsible for the health, safety and wellbeing of any attendees or participants of any swimming lessons or activities with Better Swim School. In the event of any liability or damage that may arise during or as a result of the swimming lessons or activities with Better Swim School, the winner shall liaise with Better Swim directly and Elida (and all members of the Elida corporate group) shall be held harmless to the greatest extent permitted by law.

• This Prize Draw is in no way sponsored, endorsed or administered by or associated with Instagram and Entrants shall release Instagram from any claims relating to this Prize Draw.

• These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
